Anti-Money Laundering (AML) / Counter-Terrorism Financing (CTF)

What is AML/CTF?

Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws are designed to prevent criminals from using legitimate businesses and transactions, including real estate transactions, to conceal the proceeds of criminal activity or support terrorism.

From 1 July 2026, certain real estate services in Australia are subject to the AML/CTF regime administered by the Australian Transaction Reports and Analysis Centre (AUSTRAC).

As a real estate business, Rosie Projects Pty Ltd trading as Shaddock Real Estate may be required to comply with AML/CTF obligations when providing regulated services.

What is Customer Due Diligence?

Customer Due Diligence (CDD) involves taking reasonable steps to identify and verify customers and other relevant persons involved in a regulated transaction.

Depending on the circumstances, CDD may include verifying a person's identity, identifying who owns or controls a company, trust or other entity, understanding the nature and purpose of a transaction, and undertaking additional checks where required based on the circumstances or level of risk.

Why are we requesting this information?

Shaddock Real Estate is required to comply with applicable AML/CTF obligations when providing regulated real estate services. We request this information to complete the required customer due diligence checks, meet our legal obligations and ensure that relevant property transactions can proceed in a compliant manner.

What information may we request?

Depending on the nature of the transaction, the parties involved and the ownership structure, Shaddock Real Estate may request information such as:

  • Full legal name, date of birth, residential address, contact details and occupation
  • Identification details, such as a driver’s licence or passport
  • Information about the ownership or control of companies, trusts or other legal entities, including beneficial ownership information
  • Information about the nature and purpose of the transaction
  • Where required, information relating to the source of funds and/or source of wealth.

The information requested will depend on the circumstances of the transaction, the parties involved and our legal obligations under applicable AML/CTF legislation.

Who may need to provide information?

Depending on the nature of the transaction, we may need to collect information from vendors, purchasers and other relevant parties involved in a property transaction, including individuals acting on behalf of a person or entity, company directors, trustees and beneficial owners where applicable.

How will this information be used?

Your information is collected, used and retained to meet our AML/CTF legal obligations, including identity verification, customer due diligence, risk assessment, compliance record-keeping and reporting requirements to AUSTRAC where required by law. Records will be retained for the period required by law.

How will we handle your personal information?

Shaddock Real Estate will collect only the personal information reasonably necessary to meet our AML/CTF and related legal obligations.

We take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification or disclosure.

Will my information be shared?

Your personal information may be disclosed where reasonably necessary to meet our legal obligations or where otherwise permitted or required by law.

This may include disclosure to:

  • AUSTRAC, where required by law
  • government agencies or law enforcement authorities where legally required
  • service providers assisting us with AML/CTF compliance or identity verification
  • professional advisers where reasonably necessary.

In some circumstances, we may be prohibited by law from notifying you about certain disclosures or actions taken in connection with our AML/CTF obligations.

What happens if the requested information is not provided?

Where information is required for us to meet our AML/CTF obligations, we may be unable to provide the relevant regulated service or proceed with the transaction until the required information has been provided and the necessary checks have been completed.

How long is information kept?

We retain information and records collected for AML/CTF purposes for the period required by applicable law.
